Security Deposits in Luxembourg: What Every Tenant Should Know
Under Luxembourg's rental law, a landlord cannot ask for a security deposit greater than three months' rent, whether you're renting a full apartment or a single room under a written contract. This cap exists specifically to protect tenants from excessive upfront costs.
The deposit is meant to cover unpaid rent or damage beyond normal wear and tear — it isn't a fee, and it should be returned to you once you move out, assuming the property is left in the agreed condition.
This is exactly why a written inventory (état des lieux) at move-in matters so much: it's the baseline your landlord will compare the room or apartment against when you leave, and it protects you from being charged for pre-existing wear.
If a deposit isn't returned within a reasonable period after move-out and there's no documented damage, tenants have the right to request it formally in writing, and ultimately to pursue it through Luxembourg's rental dispute channels.
